Mutual Confidentiality & Consent Agreement

(Simplified NDA Template with Explanatory Notes)

INTRODUCTIONs

This page is designed to represent an NDA template created with clarity, safety, and mutual respect between two people (or more, if agreed) who are entering into personal, emotional, sexual, or kink-based dynamics. This includes, but is not limited to: dominance/submission (D/s), hookups, emotionally vulnerable relationships, or explorations of sexual health.

It is not a contract of ownership, and it does not erase anyone’s legal rights.

It cannot and will not protect anyone who commits an illegal, abusive, or non-consensual act.

Important: NDAs cannot be used to cover up crimes. If abuse, blackmail, coercion, or threats occur, this agreement is void. Reporting such actions is not only a right, but often a legal obligation.

1. PARTIES INVOLVED

This agreement is made between:

Party A: [Full Legal Name or Alias]
Party B: [Full Legal Name or Alias]

Note:Real names should be exchanged privately (for accountability) even if aliases are used publicly.

2. PURPOSE

The purpose of this agreement is to prevent misuse of sensitive information, protect privacy, and create a written record of expectations.

This covers: personal conversations, media exchanges, emotional disclosures, sexual preferences, and other intimate information.

This does not cover: hiding illegal activity, silencing victims, or restricting someone’s right to seek safety or justice.

3. CONFIDENTIAL INFORMATION

“Confidential Information” includes but is not limited to:

• Texts, chat logs, voice notes, and DMs
• Photos, videos, and screenshots
• Sexual/kink preferences and practices
• Mental health disclosures or medical details
• Names of other partners (past or present)
• Agreements about D/s roles or rules
• Anything explicitly shared as private

If it was said or shown in confidence, it should remain there unless both parties explicitly agree otherwise.

4. EXCLUSIONS

This NDA cannot be used to block someone from:

• Reporting illegal behavior (e.g. assault, rape, coercion, stalking)
• Seeking medical or legal help
• Protecting their own physical or emotional safety

Example:

If one party experiences assault during a scene, this agreement cannot stop them from going to the police. Silence in such cases is not legally enforceable.

5. MEDIA & RECORDINGS

• No photos, recordings, or screen captures without prior, explicit consent.
• Consent means specific, informed, and documented—not assumed.
• Unauthorized recordings may lead to termination of the relationship and legal action.

Example: “I thought it was fine to film because you didn’t say no” is not consent. Silence is not consent. Assumptions are not consent.

6. PERSONAL DYNAMICS (D/s Contexts)

If this agreement is applied to D/s or roleplay scenarios:

• Safe words must be discussed and respected (e.g. Yellow = pause, Red = stop).
• Activities involving degradation or trauma triggers require explicit, prior consent.
• Submissives retain the right to stop or revoke consent at any time.
• Dominants are responsible for aftercare and safe engagement.

Note: A consensual “ownership” fantasy is not legal ownership. All rights remain intact outside the agreed roleplay.

7. HEALTH & SAFETY

Before engaging sexually, both parties agree to:

• Share recent STI/HIV testing results (e.g. within the last X weeks).
• Avoid activity under the influence of drugs/alcohol that impair judgment.
• Respect clearly defined limits and boundaries.

Example: Saying “I don’t do breath play” is a hard limit. Trying it anyway—even once—is a violation.

8. DURATION & TERMINATION

This agreement begins on [Date].

• Either party can end it at any time, in writing (text/email counts).
• If a violation occurs, the agreement may be void immediately.

Note: NDAs should never be “lifetime traps.” They should have a clear start and end, and they can always be revoked by mutual agreement.

9. VIOLATIONS

Breaking this agreement may result in:

• Ending contact or relationship.
• Legal action such as cease-and-desist or damages.
• Public distancing (without exposing private details).

Note: Consequences here are not “revenge.” They are structured responses to breached trust.

10. FINAL DECLARATION

By signing, both parties confirm:

• They read and understood the document.
• They had the chance to ask questions.
• They signed voluntarily, without coercion.
